Welcome to OMR BEAUTY and our website, omrbeauty.com (the “website”). These Terms and Conditions (the “Terms”) apply when you as a consumer, place an order through or use omrbeauty.com. The Terms constitute an agreement between you and OMR Beauty AB (CIN: 556812-6428), Frejgatan 32, 113 26 Stockholm. We ask you to carefully read these Terms before further use of the Website. We reserve the right to, at any time, make changes to our Terms and Conditions. Changes to the Terms and Conditions will be posted online at our website. “We” “our” and “ours” in the text below refers to OMR BEAUTY.

Orders

Before placing your order, please carefully review your selected items, the information you have provided and the total price of your order. Please note that products in your shopping bag are not reserved and may be purchased by other customers until your order has been accepted by us. ​​We cannot guarantee that photos provide an exact representation of a product’s appearance, since colors may look different on screen than they do in real life. Differences may also occur due to photo quality and resolution. However, we always strive to represent our products as accurately as possible.

By placing an order at omrbeauty.com you confirm that you are over the age of 18. If you are under the age of 18, parental consent is required, as stipulated in the Swedish Parental Code. We reserve the right in individual cases to deny or change your order e.g. if you have given false personal information and/or have any record for non-payment of debt.

All purchases made through the website are intended for non-commercial use only and by placing an order through the Website you confirm that you are an end consumer. Upon suspicions of you purchasing for commercial use, OMR BEAUTY reserves the right to request proof of you being an end consumer and to deny or cancel your order until such proof has been provided by you. 

After submitting your order, we will send you an automatic order confirmation via email to confirm that we have received your order, along with the receipt, price, billing and shipping addresses. If there is an error in the order confirmation, you should contact our customer service immediately.

No order confirmation received

Sometimes, due to a technical error or other circumstances beyond the control of OMR BEAUTY, your order confirmation may be delayed, or you may not receive it at all. If more than 30 minutes has elapsed since placing your order and you still haven’t received a confirmation, please contact our customer service.


Defects, Cancellations & Return rights 

We follow the recommendations of the Swedish Consumer Agency on e-commerce. Please use our form when contacting customer service and we will respond within a reasonable time. For more information, see below. 

If your package arrives damaged or opened, please notify your pickup point immediately when you retrieve the package. They have special forms for reporting damage.

You have the right to file a complaint about a defect in the item for at least three years from the date of purchase. Original defects can, for example, be manufacturing faults. 

Notice of defects should always be reported through our contact form. We may request photos of the product and a copy of your confirmation email. Notice of a defective product must be made within a reasonable time after the defect has been detected. Note that you have to save the defective product and its original packaging until the case has been resolved. If the product is not in stock or has been discontinued, we will contact you before any further action is taken. We typically process notices of a defect within 3-14 working days and will refund the amount of your order within 30 days based on the original form of payment. 

Do you need to make a return?

You as a customer have the right to cancel or withdraw your purchase for a full refund within 30 days of receiving your order by returning your product. Your right to withdraw your order or to exchange a product is provided that the product and original packaging are in the same condition as when you received it. The product you return must be sealed and unused. For health and hygiene reasons, opened and/or used beauty products are never accepted for return. You are responsible for checking that the package and products are undamaged when you receive them. 

You are responsible for the return shipping costs. When returning items, it is important that you clearly write both OMR BEAUTY and your order number on the package. We recommend you to use the same package/box that we used to send the item to you. Then, send it to:

Processing of returns typically takes between 1-3 weeks. Remember to save the receipt for your return and send it in a way that it can be traced. By doing so, we will be able to reimburse you even if the package is lost during the return delivery.


Residents of other EU countries

Residents of an EU country other than Sweden may submit complaints online via the European Commission’s online dispute resolution site at: http://ec.europa.eu/consumers/odr. In cases of dispute, we comply with decisions by the National Board of Consumer Disputes (ARN) or a corresponding dispute resolution body. Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and regulations.

Payment and pricing

If an order is placed from a country outside of the EU or the USA, the prices are excluded VAT (exception: UK and Norway). Orders shipped to countries outside of the EU or the USA may be subject to local VAT, import duties and/or taxes, which are levied once your package reaches your delivery address. You will be responsible for the payment of such import duties and taxes. The VAT will be based on your total order value, regardless of your order is subject to a campaign. It should be noted that OMR BEAUTY has no control over these charges and, since these charges are different in different countries, OMR BEAUTY cannot predict the amount. Please contact your local customs and/or tax office for more information.

Please note that the delivery costs are not included in the prices for the products. The delivery costs are shown in connection with the shipping methods at the checkout stage. 

If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by email about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be canceled. OMR BEAUTY always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a canceled order, we will repay the amount to you. 

Please note that OMR BEAUTY may cancel an order even after it has been accepted by OMR BEAUTY, provided that you realized or should have realized that the price information was incorrect.

Our payment provider is Adyen and Qliro. If your choice of payment method is not working at the time of your purchase, OMR BEAUTY reserves the right to change the payment method. 

We accept invoice, partial payment, Trustly, Swish and credit and debit cards as a payment method.

Your payment will be deducted based on the payment method you have chosen at checkout. If you chose to pay by card, it will normally be transferred within 1-3 business days after your purchase is made. As a standard procedure, we will activate the payment when the order reaches the status of "shipped," which occurs when the warehouse delivers the order. Shipping

After completing the order you will receive your order confirmation. When your order will be sent from our warehouse, you will receive an email with a tracking link so that you can track your order. The shipping depends on where you are based and on the chosen shipping option, but normally takes between 2-14 working days. The delivery time will be communicated in “check out”. Should delays in delivery occur (without us notifying you of a longer delivery time), please contact our customer service.

Outside EU and USA

Any import VAT or customs fees must be paid by you, the customer.

Campaigns

Unless otherwise stated, discount codes may not be applied to, or combined with, other campaigns or offers.

Uncollected packages

You must provide valid and accurate delivery information. If OMR BEAUTY gets back a package that was sent to the wrong address or which was never collected, you will be responsible for paying the new shipping costs, we charge a fee of or 25 EUR/USD.


Limitation of liability

We assume no responsibility for indirect damages that may arise from the product. We accept no liability for delays/errors arising out of circumstances beyond the company's control (Force Majeure). Examples of such circumstances include work conflicts, fire, war, authoritative decisions, delivery restrictions or non-delivery from suppliers. Furthermore, we accept no liability for any changes to products/product features that have been altered by a supplier or due to other factors beyond our control.

When shopping on the Website, we will process some of your personal data in order to carry out your purchase. We may also use cookies and similar techniques to enhance your experience of the Website. Your privacy is important to OMR BEAUTY. In this policy, we want to inform you about how we process your personal data and about your rights. Personal data is any information that can be connected to you as a private person, for example name and contact information.

In short, this is why we process your data:

  • To the extent necessary for handling and delivering your order.
  • To give you offers and inspiration both by newsletters, text messages and by targeted marketing in social media, and other media online and offline.
  • To communicate with you and answer your questions.
  • To ask you about OMR BEAUTY and your experience with us.
  • To remind you of an abandoned shopping cart.
  • To create and maintain a customer account (incl. features such as favorites).
  • To comply with mandatory law (e.g. consumer and accounting law).

Personal Data Act

Whenever you place an order with us, you simultaneously give us your consent to save your name, address and phone number. You also consent to our storing information on your purchases in our database. Furthermore, you give your consent for us to contact you via email or SMS. 


Right to rectification

You have a right to obtain rectification of any inaccurate personal data concerning you and to ask us to have incomplete personal data completed.

​​Governing Law And Dispute Resolution 

These Terms and your use of the Website are construed under and governed by the substantial laws of Sweden. Any dispute arising from or in connection with these Terms and your use of the Website shall be finally settled by the Swedish court. Notwithstanding the above, OMR BEAUTY has the right to, at its sole discretion, choose to take legal action against a consumer where the consumer has its permanent residence. If a dispute arises between you as a customer and OMR BEAUTY, and we are unable to resolve the dispute, you can submit a complaint to the EU’s functioning dispute settlement online, ODR. If any provision of these Terms is found to be invalid or unenforceable (partly or in whole), the provision in question shall be enforceable to the extent permitted by applicable law. The remaining terms, provisions, covenants, and restrictions set forth herein shall remain in full force and effect and shall not in any way be affected.


Miscellaneous

If any part of these Terms is held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms; instead, the invalid terms and conditions shall be replaced with the terms in order to give effect to the commercial intentions of these Terms.
